1 INTRODUCTION
This Privacy Policy explains how Fourier Space Pty Ltd ABN 83 652 372 524 (Fourier Space, we, us or our) collects, holds, uses and discloses Personal Information.
This Privacy Policy applies to Personal Information we collect in connection with our business, including the development and provision of scientific software, computing infrastructure and related professional services; our website; dealings with prospective and current clients, client personnel, suppliers, contractors and business contacts; and recruitment, employment and contractor arrangements.
In this Privacy Policy, Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information or opinion is true and whether or not it is recorded in a material form.
This Privacy Policy does not limit any confidentiality, privacy, security or data-handling obligations that apply under a separate agreement between Fourier Space and a client, supplier or other party.

2 APPLICABLE PRIVACY LAWS
We comply with applicable privacy laws, including the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) where they apply to us.
The additional provisions under the heading Additional Information for EEA and UK Individuals apply only to the extent that the General Data Protection Regulation (EU) 2016/679 (GDPR) or the UK General Data Protection Regulation (UK GDPR) applies to our handling of your Personal Information.
We do not represent that we hold any particular information-security certification, accreditation or government-security authorisation unless we expressly state this in writing.

3 TYPES OF PERSONAL INFORMATION WE COLLECT
The types of Personal Information we collect depend on our relationship with you and may include:
(a) identity and contact information, including your name, job title, employer, postal or street address, email address, telephone number and correspondence details;
(b) commercial and financial information, including client billing details, bank-account details, payment and transaction information, and information reasonably necessary to administer a contract;
(c) employment, recruitment and contractor information, including CVs, qualifications, work history, references, employment agreements, payroll information, superannuation fund and account details, emergency-contact details and performance or workplace records;
(d) government-issued identifiers and verification information, including tax file number information, passport details, driver-licence details or images, and Working with Children Check information, where reasonably necessary and permitted by law;
(e) communications and enquiry information, including information contained in emails, letters, telephone notes, website enquiries, meeting notes and other correspondence;
(f) website and technical information, including IP address, device and browser information, pages accessed, date and time of access, and cookie or similar-technology information, but only to the extent that we use those technologies;
(g) information about an individual provided to us by a client, supplier, referee, recruitment agency or other authorised third party; and
(h) any other Personal Information that is reasonably necessary for the purposes described in this Privacy Policy.
We only collect Sensitive Information where it is reasonably necessary for our functions or activities and where we are permitted or required to do so by law. We will obtain consent where required.
Where relevant to a role, we may collect Working with Children Check information. Fourier Space receives information about whether an individual holds a Working with Children Check clearance or is subject to an exclusion; it does not receive specific criminal-history information as part of that process.
We handle tax file number information in accordance with applicable taxation and privacy laws.

4 HOW WE COLLECT PERSONAL INFORMATION
We collect Personal Information directly from you when you:
(a) contact us or correspond with us by email, telephone, video conference, post or through our website;
(b) request information, submit an enquiry, request a proposal or quote, or enter into or administer a contract with us;
(c) provide services to us, apply for a role with us, work for us or engage with us as a contractor;
(d) provide payment, billing, payroll, superannuation, identity-verification or compliance information;
(e) attend a meeting, event or site visit; or
(f) otherwise provide Personal Information to us in paper, electronic or verbal form.
Our website uses functional, security and session cookies and similar technologies, including standard WordPress cookies, anti-spam fields and a security and anti-spam service on our contact form. We use a security and anti-spam service to help prevent automated bot submissions and spam.
Our website may use QUIC.cloud to process and temporarily cache data for website-performance and security purposes.
We do not use Google Analytics, Google Search Console, advertising pixels, embedded maps, YouTube or other technologies to track your browsing behaviour across websites for advertising profiling or behavioural marketing.
You may be able to manage cookies through your browser settings. However, disabling cookies may affect website functionality.

5 AUTOMATED DECISION-MAKING
We do not currently arrange for a computer program to use Personal Information to make, or to do a thing substantially and directly related to making, a decision that could reasonably be expected to significantly affect an individual’s rights or interests. We will update this Privacy Policy if this changes.

6 HOW WE USE YOUR PERSONAL INFORMATION
We may use Personal Information to:
(a) provide, develop, support, secure and improve our scientific software, computing infrastructure, professional services and website;
(b) communicate with clients, prospective clients, suppliers, partners, personnel and other business contacts, and respond to enquiries;
(c) negotiate, enter into, perform and administer contracts, including client onboarding, account management, invoicing, payment processing and debt recovery;
(d) recruit, employ, engage, pay, manage and support our employees and contractors, including administering payroll, superannuation and workplace obligations;
(e) verify identity, conduct compliance checks and protect the security and integrity of our business, systems and information;
(f) maintain business, financial, legal and operational records;
(g) obtain professional advice, manage disputes, enforce our rights and comply with legal, regulatory, taxation, reporting and record-keeping obligations; and
(h) conduct internal business planning, risk management, quality assurance and improvement activities.
Where the GDPR or UK GDPR applies, we process Personal Information where necessary to perform a contract with you or take steps at your request before entering into a contract; to comply with a legal obligation; for our legitimate interests in operating, securing and improving our business and services, provided those interests are not overridden by your rights; or with your consent where consent is required.

7 DISCLOSURE OF PERSONAL INFORMATION
We may disclose Personal Information to:
(a) our employees, officers, contractors and professional advisers who need the information for the purposes described in this Privacy Policy;
(b) service providers that support our operations, including Google Workspace services, Slack, Google Drive, Xero, Tailscale, NAB, Wise, information-technology providers, cloud-hosting providers and secure document-storage providers;
(c) clients, suppliers, business partners and other parties where reasonably necessary to perform a contract or provide services;
(d) superannuation funds, insurers, payroll providers, recruitment agencies, referees and government agencies where relevant to employment, engagement, verification or legal compliance;
(e) regulators, law-enforcement bodies, courts, tribunals and other parties where required or permitted by law; and
(f) a prospective purchaser, financier or adviser in connection with a proposed business transaction, subject to appropriate confidentiality protections.
We do not sell Personal Information.

8 SECURITY
We take reasonable steps to protect Personal Information from misuse, interference, loss and unauthorised access, modification or disclosure. Our measures include access controls, password and authentication controls, role-based access where appropriate, secure cloud-based systems, staff and contractor confidentiality obligations, and processes for managing suspected security incidents.
No method of electronic transmission or storage is completely secure. You should take care when transmitting information to us electronically.

Our website may contain links to other websites. Those links are provided for convenience and may not remain current or be maintained. We are not responsible for the privacy practices of those linked websites and we suggest you review the privacy policies of those websites before using them.

10 ACCESS AND CORRECTION
You may request access to, or correction of, Personal Information we hold about you by contacting us using the contact details below. We may ask you to verify your identity before processing a request.
We will respond within a reasonable period and in accordance with applicable law. We may refuse a request where permitted by law but will give written reasons where required.

11 ADDITIONAL INFORMATION FOR EEA AND UK INDIVIDUALS
This section applies only where the GDPR or UK GDPR applies to our processing of your Personal Information. Fourier Space will usually act as a controller of Personal Information collected directly from prospective clients, business contacts, applicants, employees and website users. Where we process Personal Information solely on behalf of a client under a written agreement, that client may be the controller and we may act as a processor.
In addition to the rights described above, you may have rights to request erasure, restriction of processing, objection to processing, data portability and withdrawal of consent. These rights are not absolute and may be subject to applicable legal conditions and exceptions.
We obtain Personal Information directly from you and from the third-party sources described in this Privacy Policy. We retain it in accordance with the section headed Retention of Personal Information.
You may lodge a complaint with the relevant data-protection authority in your EEA or UK country of residence or work, or where you consider an infringement has occurred.
Fourier Space is established in Australia and does not currently have an establishment in the EEA or the United Kingdom. Based on our current operations, we have not appointed an EEA or UKĀ representative. We will review this position if the nature, scope or targeting of our EEA or UK-related processing changes.

12 RETENTION OF PERSONAL INFORMATION
We retain Personal Information only for as long as reasonably necessary for the purposes described in this Privacy Policy, to meet legal, accounting, taxation, contractual and reporting obligations, or to establish, exercise or defend legal claims.
We may retain different categories of Personal Information for different periods. In particular, we retain employment, payroll, taxation, superannuation, contractual and financial records for the period required by applicable law or reasonably necessary for our business and legal obligations.
When Personal Information is no longer required, we will take reasonable steps to destroy or de-identify it, unless we are required or permitted by law to retain it.

13 OVERSEAS DISCLOSURES AND TRANSFERS
We use cloud-based service providers, including Google Workspace, Google Drive, Slack, Xero, Tailscale and Wise. These providers may store, process, host, back up or provide support in relation to Personal Information from locations outside Australia.
Depending on the relevant provider and service, Personal Information may be transferred to, stored in or accessed from multiple locations internationally, including Australia, the United States, countries in Europe, Asia, the Middle East, Africa and South America. Under our current service arrangements, we cannot select or require that all Personal Information is held in a particular country.
Before disclosing Personal Information overseas, we take reasonable steps, having regard to the circumstances, to ensure that the recipient handles the information in a manner consistent with applicable privacy requirements.
Where the GDPR or UK GDPR applies, we will make transfers outside the EEA or United Kingdom only using a lawful transfer mechanism, such as an adequacy decision, standard contractual clauses or another permitted safeguard.

14 COMPLAINTS
If you have a privacy complaint, please contact our Privacy Officer in writing using the contact details below and provide enough detail for us to investigate. We will acknowledge your complaint, investigate it and respond within a reasonable period.
If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner. Where the GDPR or UK GDPR applies, you may also complain to the relevant data-protection authority.
